UAPA
India's Principal Anti-Terror Law
The Unlawful Activities (Prevention) Act, 1967, is India's primary substantive law for designating and prosecuting terrorism and "unlawful activities" (acts threatening India's sovereignty and territorial integrity). It was substantially strengthened after 2004 and again by the UAPA (Amendment) Act, 2019, which extended the law's reach from banning organisations to designating individuals as terrorists.
- The First Schedule of the UAPA lists banned terrorist organisations; the Fourth Schedule (added in 2019) lists individuals designated as terrorists.
- Lashkar-e-Taiba is listed as a banned terrorist organisation in the First Schedule of the UAPA, and is also proscribed at the UN and by the United States.
- Key operative provisions used against OGWs include membership of or support to a terrorist organisation (Section 20) and raising funds for terrorist acts (Section 40); the National Investigation Agency (NIA) can take over UAPA cases with cross-state or national-security dimensions.
