India-US Trade Pact: First Phase in Legal Drafting, to Start Once India Has a Competitive Edge

What happened
01

The Union Ministry of Commerce and Industry said the first phase (first tranche) of the India-US Bilateral Trade Agreement has been finalised. Its text is now going through legal drafting (turning the agreed points into a formal legal document).

02

India plans to bring the deal into force (operationalise it) only when it gives Indian exporters a competitive advantage over peer countries, that is, better or equal terms compared with rival exporting nations selling to the US.

03

Officials said the deal will be signed once the overall US tariff structure is settled. The US is still rebuilding its tariff system after its Supreme Court struck down tariffs imposed under an emergency law in February 2026.

04

Officials linked the timing to outcomes under Section 301 of the US Trade Act, 1974, the US law used to act against "unfair" trade practices of other countries.

05

The Ministry also said the India-European Union Free Trade Agreement will be signed in December 2026 and is expected to come into force from February or March 2027.

India-US Bilateral Trade Agreement (BTA)

The India-US Bilateral Trade Agreement (BTA) is a trade deal that India and the United States are negotiating with each other. It aims to cut import taxes (tariffs) and other trade barriers so that each country can sell more goods and services to the other. Both sides agreed to build it in stages, called tranches, instead of waiting years for one big deal. The first tranche covers the most urgent tariff cuts on goods.

Connection to this news

The first tranche of the BTA is now legally drafted but not yet signed. India is waiting for the US to finish rebuilding its tariff system, so that the final deal gives Indian goods an edge over goods from competing countries.

Section 301 of the US Trade Act, 1974

Section 301 is a part of the United States' Trade Act of 1974. It lets the US Trade Representative (USTR), the US government's chief trade negotiator, investigate another country's trade practices. If the USTR decides those practices are unfair to US businesses, it can impose tariffs or other trade limits on that country. Unlike emergency tariffs, Section 301 tariffs rest on a formal investigation, so they are harder to strike down in court.

Connection to this news

Officials said the India-US deal will move forward "based on some of the outcomes under Section 301". In simple words, India wants to see the final US tariff rates on itself and its rivals before it locks in its own tariff cuts.

Free Trade Agreements: Concept and WTO Framework

A Free Trade Agreement (FTA) is a deal between two or more countries to remove or sharply cut tariffs on most of the goods they trade with each other. Each country still keeps its own tariffs for countries outside the deal. World Trade Organization (WTO) rules normally ask members to treat all members equally, but Article XXIV of GATT allows FTAs if they cover "substantially all the trade" between the partners. Modern FTAs also cover services, investment, digital trade and rules of origin (rules that decide which goods count as "made in" a partner country).

Connection to this news

The Ministry gave a clear timeline for the India-EU FTA (signing in December, entry into force early 2027) at the same time as it spoke about the US deal. Together, these deals show India moving from avoiding FTAs to actively signing them with large rich-country markets.
