First Foreign University Campus in Tamil Nadu: UGC Rules, Federal Questions and the Debate over Access
The University Grants Commission (UGC) gave final approval to the University of Western Australia (UWA) to run a campus in Chennai, at Velachery. UWA says it is the first foreign higher education provider in Tamil Nadu. The Tamil Nadu government also gave its consent.
The approval was given under the UGC (Setting up and Operation of Campuses of Foreign Higher Educational Institutions in India) Regulations, 2023. Orientation began on 5 October 2026 and classes start on 19 October 2026.
The first courses are in business, computer science, data science, artificial intelligence (AI), information technology and an MBA. UWA had already opened a campus in Mumbai in September 2026.
Some political parties and the Tamil Nadu Government Collegiate Teachers' Association opposed the approval. They argue that it pushes the commercialisation of higher education (running education mainly as a business), since first-year fees quoted from UWA's website range from about ₹14.52 lakh to ₹23.10 lakh.
The critics also point to staff shortages in public colleges: over 7,000 teaching posts are reported vacant in government arts and science colleges in the state. They say public institutions should be strengthened first, and raise concerns about access and reservation.
As of August 2026, the Union government told the Lok Sabha that the UGC had issued 16 Letters of Intent to 15 foreign institutions from Australia, Italy, the US and the UK, for campuses in cities such as Bengaluru, Greater Noida, Gurugram, Mumbai and Chennai.
UGC (Setting up and Operation of Campuses of Foreign Higher Educational Institutions in India) Regulations, 2023
These are the rules made by the University Grants Commission (UGC) that allow good foreign universities to open their own campuses in India. A foreign university that wants to come in must be among the world's top 500, or be excellent in a special field. Once the UGC approves it, the campus can give its own foreign degree to students in India. That degree is treated as equal to an Indian degree.
The University of Western Australia's Chennai campus received its final approval under these 2023 regulations. Its freedom to set fees, which these rules allow, is the main reason for the opposition in Tamil Nadu.
University Grants Commission (UGC): Role and Powers
The University Grants Commission (UGC) is the main body that looks after university education in India. It decides the minimum standards that universities must follow, recognises universities, and gives money (grants) to them. It was made a legal body by the University Grants Commission Act, 1956, and works under the Department of Higher Education in the Ministry of Education. Its head office is in New Delhi.
The University of Western Australia could open in Chennai only after the UGC gave final approval under its own 2023 regulations. The debate in Tamil Nadu shows how the UGC's national power to set standards for higher education can meet state concerns about fees, access and public universities.
Education in the Concurrent List: Constitutional Framework and History
In India, the power to make laws is divided between the Centre and the states. Education is in the Concurrent List, which means both Parliament and state legislatures can make laws on it. But this was not always so. Until 1976, education was mainly a state subject. The 42nd Constitutional Amendment Act, 1976 moved it to the Concurrent List. Even today, setting standards in higher education belongs only to Parliament.
The University of Western Australia needed approval from the UGC (a central body acting under Entry 66) and also the consent of the Tamil Nadu government. The debate in the state over fees, access and public colleges is part of a larger argument about how much say states should have over higher education in a Concurrent List system.
