Global space norms find a firm footing in India’s new re-entry rules
India's Ministry of Space, acting through the Indian National Space Promotion and Authorisation Centre (IN-SPACe), issued the country's first dedicated guidelines governing the planned re-entry of space objects (rocket bodies and satellites) into Earth's atmosphere.
The guidelines require any Indian entity conducting a re-entry — regardless of whether the object comes down over Indian territory or elsewhere — to obtain prior IN-SPACe authorisation.
Operators must demonstrate through technical analysis (trajectory prediction, de-orbit strategy, fragmentation and survivability assessment) that the probability of human casualty from the re-entry remains below the internationally accepted threshold of 1 in 10,000.
The rules come as low-earth orbit is now populated by several thousand active satellites, with private mega-constellations expected to multiply this number sharply, raising the frequency and risk profile of re-entries.
Firms are required to carry adequate insurance, including third-party liability cover where prescribed, since the Government of India does not indemnify private re-entry activity domestically even though it remains internationally liable as the "launching State."
The 1972 Liability Convention and India's international space obligations
The Convention on International Liability for Damage Caused by Space Objects (1972), one of the five core UN space treaties, holds a "launching State" absolutely liable for damage caused by its space objects on the surface of the Earth or to aircraft in flight, and liable on a fault basis for damage in outer space. India ratified this Convention and, as a launching State, bears this liability regardless of which domestic entity (government or private) actually launched or operated the object.
